1. Terms and Definitions

 

Third Party: the natural or legal person, public authority, service or any other organisation, not being the User, nor the Controller, nor the persons authorised under the direct authority of the Controller to process the data.

External Service Providers: service providers engaged by the Responsible Party for the provision of goods and services. This includes e.g. payment service providers, website hosts, transport companies and e-mail or newsletter senders. 

User: any natural person who enters one or more personal data on the Website.  

Interactive use: any use of the Website during which You actively enter personal data on the Website, whether or not via an electronic form completed by You. 

Non-interactive use: any use that cannot be considered an Interactive use. 

Privacy Act (official designation: "General Data Protection Regulation"): the Act of 5 September 2018 on the protection of natural persons with regard to the processing of personal data and by extension the European General Data Protection Regulation no. 2016/679 of 27 April 2016 (better known as the "General Data Protection Regulation" or "GDPR"). 

Controller: the controller of personal data processing, as indicated in Art. 5.   

Website: the website on which the User has entered his or her personal data.

2. Scope

 

Each visit to and use of the Website is subject to this Privacy Statement. Where applicable, the entry of personal data on the Website implies that the User has actual knowledge of the Privacy Statement and has accepted its content. This Privacy Statement may be modified without prior notice. It is therefore recommended to consult this Privacy Statement each time you visit the Website.

3. Processed data

 

Non-interactive use

 

During purely non-interactive use of this website, no personal data are processed within the meaning of the Privacy Act. 

 

Interactive use

 

During interactive use of the Website, including the creation of a profile and the placing of an order for Products, the personal data entered by the User during the Registration procedure are processed. These personal data include, depending on the function used by the User on the Website: 

  • name and first name; 
  • contact details; 
  • payment details; 
  • ... 

 

By interactively using the Website, the User grants his unambiguous consent to the processing of the personal data entered by him for the purposes for which the User has provided these personal data. In case these personal data will also be used for purposes other than the purposes referred to above, Bizbike will ensure that it always has a valid processing ground for this.

 

Google Analytics / cookies

 

Both a Non-interactive and Interactive use of this Website uses Google Analytics, a web analysis service offered by Google Inc. More specifically, Google Analytics uses so-called 'cookies'.  

 

Cookies register in a general manner data relating to the surfing behaviour of visitors and users on the Website (pages consulted, date and time of consultation, search criteria used, etc.). The visitor's IP address is also recorded. This data allows the Website, among other things, to recognise the visitor on subsequent visits and to propose adapted content.  

 

However, the visitor can refuse the use of cookies by changing the cookie settings in the configuration menu of his/her web browser, although this may have an impact on certain functionalities of the Website. The visitor can also generally prevent Google from collecting and using his/her data (IP address and cookies) by downloading and installing the browser plug-in.

4. Purposes of processing

 

The Controller processes the personal data received through this website and account for the following purposes: 

  • communication with the User; 
  • managing the profile of the User; 
  • processing orders; 
  • organising the after-sales service; 
  • making the website easily accessible (by means of so-called cookies); 
  • communication for direct marketing purposes (such as mailings or messages via social media such as Facebook, Instagram, LinkedIn, etc.)

5. Controller 

 

The Website is owned and managed by BVBA BIZBIKE, with registered office at Hooiemeersstraat 7, 8710 Wielsbeke, Belgium and registered in the Crossroads Bank for Enterprises under the number 0556.787.819  BVBA Bizbike can be reached by telephone at the number (056900655), e-mail at the address info@bizbike.be and, if necessary, by ordinary or registered mail at the address mentioned in the aforementioned paragraph.

6. Data recipients

 

The personal data processed may be communicated to the following recipients, depending on the purposes of processing, and the need to do so; 

  • the User and Responsible Party itself, as well as its commercial partners for commercial purposes, such as mailings;  
  • the hosting providers and the application development service provider or web builder; 
  • in case of purchase with online payment: to the financial institution and payment service provider used by the Responsible Party; 
  • external Service Providers necessary to execute and complete the order (e.g. the payment service providers, the carrier, ...). 

 

The aforementioned recipients will only process the personal data received in accordance with this Privacy Statement. A processing agreement will also be concluded with each of them.

7. Retention of data 

 

The data shall be kept for no longer than necessary in the context of its processing and taking into account the aforementioned purposes and the expected commitments of the Processor, including its legal obligations.

8. Confidentiality of data 

 

The Processor shall take the necessary measures to protect the personal data against access or modification by unauthorised persons, use or disclosure without the consent of the User, and destruction or (accidental) loss.  

 

Employees of the Processor who have access to personal data are required to respect its confidential nature.

9. Right of access, correction, objection, deletion, data portability, withdrawal of consent and to lodge a complaint

 

The User who knows how to identify himself/herself shall always have the right to consult his/her data, to rectify erroneous and/or incomplete data and to object, free of charge, to the use of these data for direct marketing, without having to provide any justification. 

 

The User who knows how to identify himself/herself may also request the Processor to remove, free of charge, all his/her personal data from the Processor's database. The Processor will make every effort to comply with this request as soon as possible. 

 

The User who feels short-changed is also always entitled to lodge a complaint with the controlling authority, the Belgian Data Protection Authority (https://www.gegevensbeschermingsautoriteit.be/).

10.  Social plug-ins 

 

10.1 Facebook

 

The Respondent uses on the Website social plug-ins of the social network facebook.com, which is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, U.S.A. ("Facebook"). The plug-ins are indicated by a Facebook logo. When the User visits the Website containing such a plug-in, the User's browser establishes a direct connection to Facebook's servers. The content of the plug-in is transmitted by Facebook directly to the browser. 

 

By integrating the plug-in on the Website, Facebook receives the information that the User has requested the respective page from. If the User has a Facebook account and is logged into Facebook, Facebook can link the User's visit to the respective page as well as the use of the plug-in on that page (e.g. clicking the "Like" button or the "Share on Facebook" button), to Your Facebook account.  

 

The purpose and scope of the data collection, the further processing and use of this data, as well as the relevant rights of the User and the setting options to protect their privacy, are exclusively determined by Facebook. Likewise, Facebook is the controller for the processing of this data.  If the User does not want Facebook to collect data in the aforementioned manner, he must log off Facebook before visiting the Website.
